These Terms & Conditions are frequently updated between auctions, and are subject to have changed from one auction to the next. It is absolutely imperative that all bidders read & understand ALL Terms & Conditions before participating in EACH auction! Credit card payments will be processed begining at 12pm CST. NO LIVE IN-PERSON BIDDING ALLOWED. Online bidding ONLY. *Due to increased costs, there will be a $10.00 per item internet fee beginning January 1, 2021.* Bidders registering from outside of the general geographic area of auction may be subject to acceptance by auctioneer, pending further verification of bidder's express acknowledgement and acceptance of all auction policies and procedures. All Items are sold AS-IS, with no warranties, expressed or implied, except as to ownership of the items to be sold. Item listings, information, and/or descriptions provided to the bidder by Venture Auctions or The City of Memphis is deemed reliable, but not warranted, and is intended as a guide only. Bidders should inspect auction items carefully, and bid accordingly. Bidder agrees not to base a bid solely on information provided by Venture Auctions or The City of Memphis. All bids are FINAL. All sales are FINAL. ALL law enforcement equipment will be removed from items prior to auction. This includes, but is not limited to, items such as push bars, police lights, sirens, police radios, cameras, cages, and the like. Any identifying decals on city vehicles will be removed, or otherwise permanently obscured, prior to auction. Any auction listing images depicting such items and/or decals in place are NOT representative of item status at time of auction, and are not intended to infer the inclusion of any such items as part of the sale of such items. Bidders are STRONGLY encouraged to participate in the in-person auction preview for accurate and up-to-date conditions and appearances of all auction items. In-person preview will be available at the auction site on Wednesday, August 17th, from 1-3pm CST. No effort has been made by the City of Memphis or Venture Auctions to verify the year, make, model, or condition, mechanical or otherwise, of any item on this auction. Many items could potentially operate; some items will not. Some items will have keys provided to the purchaser; many items will not. Bidders should bid accordingly. Per City of Memphis ordinance, non-licensed Individual buyers may only purchase up to 6 vehicles at the Memphis impound per calendar year. This limitiation is specific to vehicles purchased AT THE MEMPHIS IMPOUND ONLY and DOES NOT APPLY to any number of vehicles purchased at City of Memphis Surplus Auctions, or other City of Memphis auctions. Bidders MUST pay for ALL items upon which that bidder submits a winning bid amount. No exceptions. The City of Memphis goverment operates in Shelby County, Tennessee. Purchasers from outside Shelby County, Tennessee bear the sole responsibilty to be knowledgeable of any applicable motor vehicle documents and/or titling processes and requirements that could affect the transfer of a motor vehicle from the City of Memphis to an individual or business located in any jurisdiction outside of Shelby County, Tennessee. Purchasers of motor vehicles at City of Memphis auctions will receive a Paid-in-Full invoice from Venture Auctions, and a Bill-of-Sale/Odometer Statement from the City of Memphis. These documents are wholly sufficient for titling purposes in Shelby County, Tennessee, as defined by state and local regulations. No further documents will be offered by the City of Memphis and/or Venture Auctions. Examples of City of Memphis vehicle purchase paperwork will be made available to Registered Bidders upon request. Full Settlement must be made Day of Sale. NO EXCEPTIONS. Buyers may pay in-person, with cash, credit card, or certified funds, until 12pm CST on day of auction ONLY. In-person payments are received at the Venture Auctions trailer, located at the MEMPHIS IMPOUND LOT 465 Klinke Ave Memphis, TN 38127 After 12pm CST, all remaining balances will be charged to buyer's credit card on file as entered at registration. ANY declined credit card transaction WILL result in an immediate ban for that bidder from attending or participating in ANY future Venture Auctions live, online, and webcast auctions. NO EXCEPTIONS. Buyer is 100% responsible for the removal of any purchased item(s) from auction site. All purchases should be removed from the auction site within 24 hours. NO EXCEPTIONS. Items remaining onsite after 48 hours may be subject to impoundment, with the buyer subject to forfeiture of entire purchase price, including fees, at the sole discretion of the City of Memphis. Neither Venture Auctions nor the City of Memphis will assist with item removal in any way. Repairing and/or working on items in any capacity is strictly prohibited on City of Memphis property. Buyer must show paid invoice in order to remove vehicle(s) from lot. NO EXCEPTIONS. The City of Memphis reserves the right to add, delete, or alter any item prior to the opening of live/webcast bidding. Prebids will not be recognized on any vehicle/item that is removed from auction prior to opening of live/webcast bidding. Auction items left on City of Memphis property after the auction are the sole responsibility of the buyer. Neither Venture Auctions nor the City of Memphis will recognize any claims for theft, damage, or loss once the item has been awarded. In the event of a tie-bid between online bidders, the tie goes to the first bid recieved. In the event of a tie-bid between any online bid and any live bidder during the live webcast auction, the tie goes to the onsite bidder. Auctioneer's decision is final and binding on all parties in the event of any dispute. Bidder's acknowledgement of this stipulation and consent to abide by it, and all other terms & conditions of this sale, are implied by bidder's decision to register for and participate in the auction, and expressed by bidder's acknowledgement and acceptance of these terms and conditions at the time of registration. Live Webcast or Online-Only Auctions involve fallible technology beyond the control of Venture Auctions and The City of Memphis. In the event of outage, for any reason, Venture Auctions reserves the right to postpone, pause, or restart bidding on individual items, or on the entire auction, at its sole discretion. In the event of auction postponement, ALL previously placed pre-bids or live bids may be nullified at the sole discretion of Venture Auctions. Announcements on day of auction take precedence over any printed or previous information.
