At the conclusion of the auction, invoices will automatically be charged. If applicable, shipping and/or delivery costs will be charged separately approximately three business days after the auction end date. Declined cards will be charged an additional $10 recharge fee, so please make sure the card you have on file with HiBid is correct and ready to receive the auction charges. On The Spot Auction Company accepts the following forms of payment: " Cashier's checks (For invoices $1,000 and above) " Wire Transfers (A $15 service fee will apply to all payments made via wire transfer. For wire transfer instructions, please email kerry@onthespotauction.com) " Credit Cards (MasterCard and Visa.) Your Billing & Shipping address must match. Merchandise becomes the full responsibility of the bidder at time of payment and the bidder assumes all risk of loss and damage to property at that time. On The Spot Auction Company reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the bidder will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property. Buyer's Premium: There is a 13.5% Buyer's Premium in effect for this auction (includes 3.5% CC Fee). Shipping is available with $5 minimum S&H fee and will increase based on weight and insurance requirements. Includes $50 Insurance, if you require additinal insurance (at your cost) please email and let us know. Packages are mailed with a tracking number and become your responsibility at the point the tracking number becomes active by the shipping carrier. The better rate of USPS or UPS will be used. 1. Disclaimer: All lots sell as is, where is, with all faults. On The Spot Auction Company and the seller do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. On The Spot Auction Company encourages all bidders to preview lots in person before bidding. On The Spot Auction Company is not responsible for incorrect listing information, if any. On The Spot Auction Company has attempted to provide accurate descriptions of all items, however, it is the bidder's responsibility to determine the condition and suitability of each lot. Printed statements or descriptions by On The Spot Auction Company staff are provided in good faith and are matters of opinion. 2. No Buybacks: All sellers are contractually prohibited from bidding on lots they have consigned to the auction. 3. No Returns: All sales are final. There are no returns, refunds, or adjustments. 4. Buyer's Premium: A buyer's premium of ten percent (13.5%) of the high bid will be added to the high bid to determine the final sales price for the auction lot. 5. Outbid Notification: The bidding software will notify bidders when they have been outbid, unless you have disabled in your preferences/profile. 6. Buyer Default: If, after the Payment Period has ended, the Buyer does not make full payment in accordance with the terms set forth above, the Buyer is considered in default and their Auction Item(s) will be re-listed in an Online Auction and a 15% re-listing fee (which You agree is a reasonable estimate of the minimum damages incurred by On The Spot Auction Company as a result of Your failure) will be charged to buyers account. The re-listing fee is based upon the original selling price of the Auction Item. By registering a valid credit card, the Buyer authorizes On The Spot Auction Company to charge applicable re-listing fees to the credit card. If items are not picked up within the announced /published pick-up date and time, their items will be considered abandoned and will be disposed of. Unfortunately, On The Spot Auction Company is not able to offer storage space. 7. Debt Collection and Interest Charges: The bidder agrees to pay all reasonable attorney fees and other costs incurred by On The Spot Auction Company in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due On The Spot Auction Company. Any debt collection or dispute proceedings will be heard in Rutherford County, Tennessee. 8. Guaranty Agreement: By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to On The Spot Auction Company of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee. 9. Limitation of Liability: If, for any reason, On The Spot Auction Company is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of On The Spot Auction Company, if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser. 10. Pickup will be Monday, May 30, 2022 2-6pm CST in Smyrna, TN **Without Exception See individual items for exact closing times. Shipping/Delivery available on most lots. **We cannot ship/deliver furniture or individual items weighing more than 50lbs. ***We offer home delivery to: Murfreesboro, TN for $6 and Remaining Rutherford Co. for $8 Davidson Co., Williamson Co., Wilson Co., Jackson Co. and McMinnville for $12 upon request. Deliveries will be made on Wednesdays & Saturday's. Delivery Charge is per auction (NOT ITEM). Any purchases remaining after 6PM on Monday, May 30th, will be considered abandoned as stated in the Terms & Conditions.
